  1. 1. POLICY STATEMENT
    your company recognises that mental health is as important as physical health and that supporting employee wellbeing is both a legal obligation and a business priority.
  2. 2. STRESS RISK ASSESSMENT
    your company will carry out a stress risk assessment using the HSE Management Standards as a framework, considering the following six areas:
  3. 3. MENTAL HEALTH FIRST AIDERS
    your company has trained … Mental Health First Aiders (MHFAs) who act as a point of contact for employees experiencing a mental health issue.
  4. 4. EMPLOYEE ASSISTANCE PROGRAMME (EAP)
    All employees have access to the company's Employee Assistance Programme, which provides confidential counselling, legal, financial and wellbeing support.
  5. 6. REASONABLE ADJUSTMENTS
    Where a mental health condition amounts to a disability under the Equality Act 2010, the company has a duty to make reasonable adjustments.
  6. 7. REVIEW
    This policy will be reviewed annually alongside the stress risk assessment.

Is a mental health & wellbeing policy a legal requirement?

It rests on Health and Safety at Work etc. Act 1974 and Management of H&S at Work Regulations 1999 and HSE Work-Related Stress Standards. Some policies must be written down once a business reaches a certain size or does certain work; others are simply how a tribunal, an inspector or a client's auditor expects to see that you have thought about it.
