What the policy covers

  1. 1. POLICY STATEMENT
    your company recognises that asbestos-related disease remains the single greatest cause of work-related deaths in Great Britain.
  2. 2. DUTY TO MANAGE (REGULATION 4)
    Where your company is the dutyholder for any non-domestic premises (owner, occupier or person in control), we must:
  3. 3. BEFORE WORK BEGINS (REFURBISHMENT AND DEMOLITION)
    Before any refurbishment, maintenance or demolition work is carried out on premises built before the year 2000, a refurbishment/demolition survey (R&D survey) must be commissioned
  4. 5. PRESUMPTION RULE
    If in doubt, assume a material contains asbestos until a survey or sampling confirms otherwise.
  5. 6. EMERGENCY STOP PROCEDURE
    If an employee or contractor discovers what they suspect may be an ACM or causes an accidental disturbance of asbestos:

    All employees who may work on or near ACMs will receive asbestos awareness training (Category A).
  8. 8. HEALTH SURVEILLANCE
    Employees who carry out notifiable non-licensed or licensed asbestos work must undergo medical surveillance by an HSE-appointed employment medical adviser.
  9. 9. REVIEW
    This policy will be reviewed annually and following any incident involving suspected asbestos disturbance.

Is a asbestos policy a legal requirement?

It rests on Control of Asbestos Regulations 2012 and Health and Safety at Work etc. Act 1974. Some policies must be written down once a business reaches a certain size or does certain work; others are simply how a tribunal, an inspector or a client's auditor expects to see that you have thought about it. A clear, dated, signed policy is the evidence either way. Guidance, not legal advice.
